1. Contract and eligibility
These terms govern paid and free access to Consentory, a hosted software service for cookie and tracker discovery, consent configuration, prior blocking controls, consent signalling and evidence records. By creating an account or purchasing a plan, you confirm that you are at least 18, can form a contract, and have authority to bind the subscribing organisation. The order shown at Checkout, these terms, the Privacy Notice, Refund and Cancellation Policy, Service Delivery Policy and Acceptable Use Policy form the agreement.
2. What the service provides
Plan descriptions on the Pricing page state included websites, scans and operational features. Consentory provides technical tooling and is not a law firm, legal opinion, certification or guarantee of compliance. You remain responsible for your legal bases, notices, vendor instructions, data maps, retention, international transfers, target-country review and final implementation.
3. Account responsibilities
You must provide accurate information, protect credentials, enable appropriate security controls, maintain authorised user access and register only websites you own or are authorised to manage. Notify support@consentory.io promptly of suspected compromise or billing errors.
4. Order, prices, currency and taxes
The Pricing page and Stripe Checkout identify the selected plan, billing interval and price in euros (EUR). Public catalogue prices exclude VAT or similar taxes unless expressly stated otherwise. Stripe Checkout calculates applicable tax from billing details where enabled. The order becomes effective when Stripe confirms payment and we activate the paid entitlement.
5. Recurring billing authorisation
Paid plans are subscriptions. You authorise AKSAMIT PROJECTS sp. z o.o. and Stripe to charge the selected amount, applicable taxes and any clearly disclosed adjustments to the payment method for each monthly or annual renewal until cancellation. Annual plans are charged for the full annual term; monthly plans are charged each month. Receipts and invoices are made available through Stripe and the billing workspace.
6. Renewal, plan changes and failed payments
Subscriptions renew automatically for the same interval unless cancelled before the renewal date. Upgrades, downgrades and prorations shown by Stripe take effect according to the billing portal confirmation. If payment fails, Stripe may retry collection and we may restrict paid capacity after notice. Existing consent evidence remains subject to retention and export rules.
7. Digital delivery
No physical goods are shipped. Paid access is normally provisioned automatically after successful Checkout and webhook confirmation. The full delivery process and remedies are described in the Service Delivery Policy.
8. Cancellation
You can cancel without contacting sales through the Stripe Customer Portal linked from Billing. Unless the confirmation states otherwise or mandatory law requires an earlier end, cancellation stops renewal and takes effect at the end of the paid term. The account then returns to available free-plan limits. Cancellation and refund eligibility are separate questions.
9. Consumer withdrawal rights
If you contract as an EU/EEA consumer, you may have a statutory 14-day withdrawal right. By requesting immediate digital service during that period, you expressly request performance to begin and acknowledge that a proportionate charge may be due for service supplied before withdrawal. Any loss of a withdrawal right applies only where legal requirements for that loss are satisfied.
10. Promotions and trials
A promotion or trial applies only when its duration, eligibility, renewal price, expiry and restrictions are displayed before acceptance. Unless explicitly stated, promotions cannot be combined, have no cash value and do not alter taxes. We do not currently promise a free trial merely because a free plan exists.
11. Customer data and data protection
You control data submitted for managed websites and instruct us to process it only to provide, secure and support the service and comply with law. You warrant that your instructions and use are lawful. Each party must comply with applicable data protection law. Processor obligations can be documented in a data processing agreement where required.
12. Intellectual property
We and our licensors retain rights in the service, software, documentation and branding. You retain rights in customer content and grant us a limited right to host, process and transmit it solely to provide and secure the service. Feedback may be used without identifying you or disclosing confidential information.
13. Availability and support
We use reasonable care to operate the service but do not promise uninterrupted availability unless a separate signed service level agreement says so. Maintenance, third-party outages and emergency security work may affect access. Standard support is available during the hours listed on the Contact page.
14. Acceptable use and suspension
The Acceptable Use Policy is part of these terms. We may suspend access where reasonably necessary for security, unlawful activity, sanctions risk, non-payment or material breach. Where practical, we will explain the reason and allow a cure.
15. Warranties and liability
Nothing excludes liability or statutory rights that cannot lawfully be excluded. To the extent permitted by law, the service is provided with reasonable care but without warranties of legal compliance or fitness for an undisclosed purpose. Aggregate liability arising from the paid service is limited to direct losses and fees paid for that service in the preceding 12 months. The limitation does not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or other non-excludable liability.
16. Termination and export
You may stop using the free service at any time and may request account deletion. Before paid access ends, export records you are required to retain. We may terminate for uncured material breach or where continued service would be unlawful. Sections intended to survive, including payment, intellectual property, liability and dispute terms, remain effective.
17. Governing law and disputes
The agreement is governed by the laws of Poland and disputes are subject to the competent courts in Warsaw, Poland, subject to mandatory consumer rights. Consumers retain mandatory protections and access to courts that cannot be waived in their country of residence. Contact legal@consentory.io first so we can attempt to resolve the issue.
18. Changes
We may update these terms for legal, security or service changes. Material adverse changes will be notified in advance where reasonably possible. Continuing a paid subscription after the stated effective date constitutes acceptance only to the extent permitted by law.
